Obtaining a Fiancée or Marriage Visa

There are four ways a spouse or future spouse can obtain lawful residency in the U.S.

  • You can apply for a K-1 visa for your fiancé or fiancée who lives abroad. Once your future spouse comes to the U.S., you have 90 days to get married. Your spouse can then apply for lawful permanent residency, otherwise known as a green card.
  • If you are a U.S. citizen and marry someone abroad, your spouse can apply for an immigrant visa as a spouse of a U.S. citizen (IR1 or CR1) or a non immigrant visa for a spouse (K-3 visa).
  • If you come to the U.S. and marry someone here, you can apply for an immigrant visa as the spouse of a U.S. citizen and obtain lawful permanent residency, otherwise known as a green card.

Note: A holder of a K-3 visa is allowed multiple re-entry into the United States and advanced parole is NOT needed.
